农业部关于加快推进农产品质量安全追溯体系建设的意见
Ministry of Agriculture on accelerating the views of the quality and safety of agricultural products traceability system construction
各省、自治区、直辖市及计划单列市农业(农牧、农村经济)、畜牧兽医、农垦、渔业厅(局、委、办),新疆生产建设兵团农业(水产)局:

为贯彻落实《中共中央、国务院关于落实发展新理念加快农业现代化实现全面小康目标的若干意见》(中发〔2016〕1号)和《国务院办公厅关于加快推进重要产品追溯体系建设的意见》(国办发〔2015〕95号)精神,进一步提升农产品质量安全监管能力,落实生产经营主体责任,增强食用农产品消费信心,现就应用现代信息技术加快推进全国农产品质量安全追溯体系建设提出如下意见。

一、总体要求

(一)指导思想。贯彻落实党的十八大及十八届三中、四中、五中全会精神和《食品安全法》《农产品质量安全法》等法律要求,全面推进现代信息技术在农产品质量安全领域的应用,加强顶层设计和统筹协调,健全法规制度和技术标准,建立国家农产品质量安全追溯管理信息平台(以下简称“国家平台”),加快构建统一权威、职责明确、协调联动、运转高效的农产品质量安全追溯体系,实现农产品源头可追溯、流向可跟踪、信息可查询、责任可追究,保障公众消费安全。
(A) guiding ideology. (二)基本原则。坚持政府推动与市场引导相结合,明确政府、生产经营主体、社会化服务机构的职责定位,调动各方积极性;坚持统筹规划与分步实施相结合,做好顶层设计和整体规划,先行开展试点,分步推广应用;坚持农业部门主导与部门协作相结合,建立追溯管理与市场准入衔接机制,加强与有关部门的协作,保障追溯体系全程可控、运转高效。
(B) basic principles. (三)主要目标。建立全国统一的追溯管理信息平台、制度规范和技术标准,选择苹果、茶叶、猪肉、生鲜乳、大菱鲆等几类农产品统一开展追溯试点,逐步扩大追溯范围,力争“十三五”末农业产业化国家重点龙头企业、有条件的“菜篮子”产品及“三品一标”规模生产主体率先实现可追溯,品牌影响力逐步扩大,生产经营主体的质量安全意识明显增强,农产品质量安全水平稳步提升。

二、全面统筹规划,实现整体推进

(四)建立追溯管理运行制度。出台国家农产品质量安全追溯管理办法,明确追溯要求,统一追溯标识,规范追溯流程,健全管理规则。加强农业与有关部门的协调配合,健全完善追溯管理与市场准入的衔接机制,以责任主体和流向管理为核心,以扫码入市或索取追溯凭证为市场准入条件,构建从产地到市场到餐桌的全程可追溯体系。鼓励各地会同有关部门制定农产品追溯管理地方性法规,建立主体管理、包装标识、追溯赋码、信息采集、索证索票、市场准入等追溯管理基本制度,促进和规范生产经营主体实施追溯行为。

(五)搭建信息化追溯平台。建立“高度开放、覆盖全国、共享共用、通查通识”的国家平台,赋予监管机构、检测机构、执法机构和生产经营主体使用权限,采集主体管理、产品流向、监管检测和公众评价投诉等相关信息,逐步实现农产品可追溯管理。各行业、各地区已建追溯平台的,要充分发挥已有的功能和作用,探索建立数据交换与信息共享机制,加快实现与国家追溯平台的有效对接和融合,将追溯管理进一步延伸至企业内部和田间地头。鼓励有条件的规模化农产品生产经营主体建立企业内部运行的追溯系统,如实记载农业投入品使用、出入库管理等生产经营信息,用信息化手段规范生产经营行为。

(六)制定追溯管理技术标准。充分发挥技术标准的引领和规范作用,按照“共性先立、急用先行”的原则,加快制定农产品分类、编码标识、平台运行、数据格式、接口规范等关键标准,统一构建形成覆盖基础数据、应用支撑、数据交换、网络安全、业务应用等类别的追溯标准体系,实现全国农产品质量安全追溯管理“统一追溯模式、统一业务流程、统一编码规则、统一信息采集”。各地应制定追溯操作指南,编制印发追溯管理流程图和明白纸,加强宣传培训,指导生产经营主体积极参与。

(七)开展追溯管理试点应用。国家平台将于2017年上线,届时将选择部分基础条件好的省份开展区域试运行,根据试运行情况进一步完善国家平台业务功能及操作流程。优先选择苹果、茶叶、猪肉、生鲜乳、大菱鲆等几类农产品统一开展试点,不断总结试点经验,探索追溯推进模式,逐步健全农产品质量安全追溯管理运行机制,进一步加大推广力度,扩大实施范围。

三、推动多方参与,规范实施要求

(八)强化农业部门追溯管理职责。各地要按照属地管理原则,建立生产经营主体管理制度,将辖区内农产品生产经营主体逐步纳入国家平台管理,组织生产经营主体实施追溯,并对落实情况进行监督。组织辖区内监管、检测机构加快应用国家平台,规范开展监管、检测信息采集,及时将基地巡查、执法检查、检验检测、产品认证、评估预警等信息纳入国家平台管理。开展追溯示范点创建活动,组织辖区内统一规范开展追溯工作,发挥示范带动作用。

(九)落实生产经营主体责任。农产品生产经营主体应按照国家平台实施要求,配备必要的追溯装备,积极采用移动互联等便捷化的技术手段,实施农产品扫码(或验卡)交易,如实采集追溯信息,实现信息流和实物流同步运转。鼓励和引导有条件的生产经营主体实施农产品包装上市,加施追溯标识,确保农产品可溯源。有条件的地区可由政府统一配备必要的追溯装备设施。

(十)发挥社会化服务作用。在国家统筹指导下,创新市场机制,有序引导社会力量和资本投入追溯体系建设。激发第三方机构活力,鼓励其为国家平台提供配套服务,为农产品生产经营主体提供技术支撑,推动追溯服务业规范发展。

四、加强监督管理,拓展追溯功能

(十一)加强追溯监督检查。农业部门要加强追溯信息在线监控和实地核查,重点对主体管理、信息采集、标识使用、扫码交易等有关情况实施监督,推进落实各方责任。规范监管、检测机构信息采集管理,确保监管、检测信息及时准确上传。健全追溯管理激励、惩戒机制,建立生产经营主体信用档案和“黑名单”制度,对不履行追溯义务、填报信息不真实的生产经营主体,加大惩戒力度。

(十二)发挥追溯功能作用。加强国家平台功能应用,积极开展农产品全程追溯管理,强化线上监控和线下监管,快速追查责任主体、产品流向、监管检测等追溯信息,提升综合监管效能。用可追溯制度倒逼生产经营主体强化质量安全意识,加强内部质量控制,落实好第一责任。畅通公众查询、投诉渠道,提高农产品生产经营过程透明度,解决农产品生产经营信息不对称问题,提振公众消费信心。

(十三)提升智慧监管能力。建立“用数据说话、用数据管理、用数据决策”的管理机制,充分发挥国家平台决策分析功能,整合主体管理、产品流向、监管检测、共享数据等各类数据,挖掘大数据资源价值,推进农产品质量安全监管精准化和可视化。建立追溯管理与风险预警、应急召回的联动机制,提升政府决策和风险防范能力,加强事中事后监管,提高监管的针对性、有效性。

五、强化保障措施,夯实工作基础

(十四)健全工作体系。依托现有农产品质量安全监管机构或具有农产品质量安全职能的事业单位建立健全农产品质量安全追溯管理体系队伍,落实各方职责,积极争取工作经费和保障条件。加强人员培训,提高基层追溯管理业务能力和水平。组建全国农产品质量安全追溯专家组,为农产品追溯体系建设提供技术支撑。
建立安全法规标准、事故案例、视频课程、统计数据等信息资源库

(十五)完善法律制度。加快推进《农产品质量安全法》修订步伐,充分借鉴国外立法经验,推动农产品质量安全追溯管理法治化,重点将主体管理、市场准入、主体责任、监督管理、处罚措施等关键要素纳入法律范畴,为追溯管理提供法律依据。

(十六)加强政策扶持。落实属地管理责任,加快追溯管理基础设施建设,完善生产经营主体、检测机构和基层监管机构追溯装备条件。积极争取和出台农产品质量安全追溯管理扶持政策,加大对生产经营主体追溯装备设施配置、信息采集和标识使用补贴力度,建立追溯与项目扶持挂钩机制,提高生产经营主体实施追溯的积极性。支持引导社会资本参与追溯体系建设,形成多元化的资金投入机制,完善追溯技术研发与相关产业促进政策。

(十七)强化社会共治。深入开展有关法律法规和标准宣传贯彻活动,普及追溯知识,传播追溯理念,提升企业自律意识和责任意识,提高公众对可追溯产品的认知度。加强政府与公众的沟通交流,建立违法行为信息披露制度和有奖举报机制,发挥舆论监督作用,推动形成全社会关心追溯、使用追溯、支持追溯的良好氛围。
